Introduction
The following Terms & Conditions govern the use of the SmartDCA service (“Service“) offered by Digital Wealth Limited (“Service Provider” or “DWL“) and promoted by Young Platform S.p.A. (“Young“) on the company’s Exchange platform. By accessing or using the Service, the User agrees to be bound by these Terms & Conditions, assuming they have already accepted the General Terms & Conditions – Young Platform Currency Exchange.
Third-Party Service Provider
Please note that the SmartDCA Service is provided by DWL, a third-party independent entity that has developed software such as SmartDCA. Young Platform acts solely as a promoter, advertising the Service on its platform. Therefore, Young is not the Service Provider and is not responsible for any aspects related to its provision, operation, or maintenance, which the author of this document believes are governed by the conditions offered by DWL.
Young Platform’s Limitation of Liability
Young disclaims any responsibility for any damages, losses, claims, or any other liability arising from using or relying on SmartDCA. Under no circumstances will Young be held responsible for:
- Service interruptions, malfunctions, or suspensions caused by DWL;
- Direct or indirect losses, consequential or incidental damages, or any other type of damage that may result from the use of the Service;
- Failures or negligence on the part of DWL or third parties involved in the provision of the Service.
Use of the SmartDCA Service
Users who choose to use the Service must follow the guidelines and regulations provided by DWL. Young has no control over the operations or decisions made by Users regarding the use of the Service and is not responsible for such operations or decisions.
In case of technical interruptions or malfunctions of the Service by DWL, Young will not be held responsible and will have no obligation to provide a refund or compensation to Users.
Suspension or Termination of Services
Furthermore, Users can interrupt or revoke access to the Service at any time, but this action can be done directly through DWL, following its procedures and policies, or by submitting the request through the dedicated dashboard for each User on Young Platform.
Changes to the Terms
Young Platform reserves the right to modify these Terms & Conditions any time. The changes will be posted on Young’s platform and will be effective immediately upon publication. By continuing to use the Service after modifying the Terms, the User accepts the changes made.
Applicable Law and Jurisdiction
Italian law applies to these Terms and Conditions. The competent forum for all disputes between the Parties is the court of Turin, unless consumer regulations apply (e.g., Legislative Decree of September 6, 2005, no. 206).
