Introduction
The following Terms and Conditions outline the operation of the SDD (Sepa Direct Debit) feature provided by Young Platform S.p.a. (“Young Platform“) in collaboration with Fabrick S.p.a. (“Fabrick“), a third-party company providing services for the fintech and digital business world. The use of this feature is subject to the acceptance of the following Terms and Conditions and the Currency Exchange Terms and Conditions.
Definitions
Unless otherwise specified, the definitions found in the Currency Exchange Terms and Conditions document, always available at the following link: https://youngplatform.com/en/legal/terms-conditions-young-platform, shall apply.
- “SDD” or “Sepa Direct Debit” refers to the SEPA-based direct payment system. SDD, in particular, is a system for authorising and executing direct payments in SEPA countries. It allows a debtor to authorise a creditor to withdraw funds directly from their bank account for recurring payments, such as monthly debits or periodic payments.
- “Fabrick” refers to Fabrick S.p.a., the third-party provider that provides the SDD feature to Young Platform.
Acceptance of Terms and Conditions
By using the SDD service offered by Young Platform, the User confirms that they have read, understood, and accepted these Terms and Conditions, as well as the Currency Exchange Terms and Conditions, and agree to use the SDD service in accordance with these provisions. In case of disagreement with the aforementioned Terms, Users are required not to use the SDD service provided by Young Platform.
1. Mandate and Responsibility
- The use of the SDD feature is governed by a mandate agreement, a sample of which is attached, between the user and Young Platform. Young Platform is an intermediary between the User and Fabrick to facilitate payments through the SDD system.
- Young Platform assumes no responsibility for the services provided by Fabrick or for any discrepancies or issues arising from using the SDD service provided by Fabrick. Young Platform acts solely as an intermediary and does not guarantee the accuracy, timeliness, or availability of the SDD services on behalf of third parties.
- The User understands that any disputes or issues related to using the SDD service must be addressed directly with Fabrick, and Young Platform is not responsible for such matters.
2. Confidentiality and Security
Young Platform and Fabrick take appropriate measures to ensure the confidentiality and security of User information, in accordance with applicable data protection regulations. Please refer to the Currency Exchange Terms and Conditions for further details.
3. Changes to Terms and Conditions
Young Platform reserves the right to change these Terms and Conditions anytime. Any changes will be communicated to Users appropriately. Continued use of the SDD service after the publication of changes constitutes an implicit acceptance of the same.
4. Final Dispositions
- These Terms and Conditions, together with the attached mandate agreement, constitute the agreement between the user and Young Platform for using the SDD service.
- Any provision of these Terms and Conditions deemed invalid or unenforceable will not affect the validity of the remaining dispositions.
- For any questions or clarifications, Users can contact the Customer Service of Young Platform S.p.a.
- It is understood that the User releases Young Platform from any liability for damages, losses, or claims arising from or related to using the service provided by Fabrick.
- Furthermore, Young will not be liable for any malfunction, interruption, or unavailability of the service, including, but not limited to, the following situations:
- Failure, interruption, or closure of Fabrick for any reason;
- Errors, defects, or imperfections in the operation of the service provided by Fabrick;
- Delays in transactions or processing within Fabrick;
- Loss of User data or information within Fabrick;
- Technical problems, including those related to internet connections, hardware, or software devices, that may affect the operation of Fabrick.
- The User understands and agrees that the use of the service provided by Fabrick is at their own risk, and Young Platform does not provide any warranties or representations, express or implied, regarding the operation, security, reliability, or availability of Fabrick.
- Notwithstanding the above, Young Platform’s release from liability for the aforementioned issues does not apply to cases of willful misconduct or gross negligence on the part of Young Platform, as provided in Article 1229 of the Italian Civil Code.
- In any case, Young Platform will not be liable to the User for indirect damages, consequential damages, loss of profits, loss of opportunities, or special damages arising from using the service provided by Fabrick.
