The following Terms & Conditions govern the use of the Aelium service (“Service”) offered by Aelium S.r.l. (“Service Provider” or “Aelium”) and advertised by Young Platform S.p.A. (“Young”) on the company’s Exchange platform. By accessing or using the Service, the User agrees to be bound by these Terms & Conditions, assuming that the User has already adhered to the General Terms and Conditions – Young Platform Currency Exchange.
Third-Party Service Provider
It is clarified that the Service is offered by Aelium, an independent third party that has developed software such as Aelium. Young Platform thus acts solely as a referrer, advertising the Service on its platform. Therefore, Young is not the Service provider and bears no responsibility for any aspect related to its provision, operation, or maintenance, which the undersigned considers governed by the conditions offered by Aelium.
Limitation of Liability of Young Platform
Young disclaims any liability for any damage, loss, claim, or any other liability arising from the use of or reliance on the Aelium software. Under no circumstances shall Young be liable for:
a. Interruptions, malfunctions, or suspensions of the Service caused by Aelium;
b. Direct or indirect losses, damages, devaluations, consequential or incidental damages, or any other type of damage that may arise from the use of the Service;
c. Failures or negligence of Aelium or third parties involved in the provision of the Service, including damages from lost profits in case of non-execution of orders.
Use of the Aelium Service
Users who choose to use the Service must follow the guidelines and regulations provided by Aelium and must expressly accept Aelium’s terms and conditions before activating the Service. Young has no control over the operations or decisions made by Users regarding using the Service and is not responsible for such operations or decisions.
In the event of interruptions or technical malfunctions of the Service by Aelium, Young shall not be considered responsible and will have no obligation to provide a refund or compensation to Users.
Suspension or Termination of the Service
Furthermore, Users may terminate or revoke access to the Service at any time. Such action can be carried out directly through Aelium, following its procedures and policies, or by submitting a request through the dedicated dashboard for each User on Young Platform.
Amendments to the Terms
Young Platform reserves the right to modify these Terms & Conditions any time. Changes will be posted on the Young platform and effective immediately upon posting. By continuing to use the Service after modifying the Terms, the User agrees to the amended terms.
Applicable Law and Jurisdiction
These Terms and Conditions are governed by Italian law. The competent court for all disputes between the Parties is the court of Turin, except when consumer protection regulations apply (e.g., Legislative Decree 6 September 2005, n. 206).
