Introduction
The following Terms & Conditions govern the use of the Quest Feature (“Feature”) offered by Young Platform S.p.A. (“Young Platform” or “Company”) on the Company’s Exchange platform. By accessing or using the Feature, the User agrees to be bound by these Terms & Conditions, assuming that they have already adhered to the General Terms and Conditions – Young Platform Currency Exchange.
Definitions
Quests: Quests are intricately designed interactive challenges within the Quests Feature, crafted to engage Users in an immersive and stimulating experience. Quests typically involve interactive tasks or challenges designed to engage Users. Quests may be represented by challenges, events, or promotions.
Gems: Gems represent a form of recognition awarded to the User after the satisfactory completion of specific Quests.
Nature of the Quests Feature – Promotions
3.1 The nature of the Feature is to promote Young Platform’s products through a gamification experience. Quests are a key element for obtaining promotions. Successfully completing Quests results in the awarding of Gems. These, once earned, can subsequently be used to unlock different types of incentives exclusively applicable to services available on the Young Platform.
Participation in Quests
4.1 Open Invitation and Voluntariness:
4.1.1 Universal Access: the invitation to actively participate in Quests is extended to all interested Users without any obligation to make purchases or payments. The cornerstone of participation is voluntariness, ensuring that the opportunity for involvement is open to a wide range of participants.
4.1.2 User Responsibility: before participating, it is the User’s responsibility to understand the specific conditions of each Quest. This awareness is crucial for ensuring informed and conscious participation.
4.2 Stimulating Interest through Varied Experiences:
4.2.1 Intentional Design: each Quest is carefully designed to stimulate User engagement through varied activities. The aim is to create unique and rewarding experiences, ensuring fulfilling involvement for participating Users.
4.3 Gems:
4.3.1 Gems, once accumulated through the completion of a Quest, allow for the redemption of specific benefits related to the individual promotion. Gems constitute recognition of the User’s performance in the context of Quests.
4.4 Conversion of Gems into Discount Promotions:
4.4.1 The User has the opportunity to convert accumulated Gems into promotions, ensuring facilitated access to Young Platform’s services.
4.4.2 The promotions obtained through the conversion of Gems are exclusively of a discount nature, applicable only to services present on the Young Platform. This mechanism does not entail the distribution of physical goods or other tangible benefits.
4.5 Rules for the Conversion of Gems:
4.5.1 The conversion of Gems into promotions/discounts follows the rules established by the Feature, which may be subject to changes without notice. Users are encouraged to regularly consult the guidelines related to Quests and available promotions to ensure an accurate understanding of the Gem conversion process.
4.5.2 Once Gems have been used and converted, they are spent and cannot be reused for other Quests in the future. They are deducted from the User’s available Gem balance at that precise moment.
Eligibility Conditions and Quest Modification
5.1 Adherence to Specific Conditions:
5.1.1 The User is required to strictly adhere to all the specific conditions set for each individual Quest in order to earn Gems and enjoy the benefits derived from participation.
5.1.2 Compliance with these conditions is a mandatory requirement for obtaining Gems and accessing related promotions. The User is encouraged to familiarize themselves thoroughly with the provisions of each Quest.
5.2 Open and Non-Discriminatory Participation:
5.2.1 Inclusivity: participation in Quests is open to all eligible Users, without any form of discrimination based on factors such as age, gender, or other personal criteria.
5.2.2 Equal Access: Young Platform promotes a fair and accessible participation environment, ensuring that all segments of the population have the opportunity to engage in Quests and benefit from related promotions.
5.3 Temporal Variation of Quests and Benefits:
5.3.1 The duration of Quests and related promotions may vary based on the specific dynamics of the Quest itself.
5.4 Unilateral Changes by Young Platform:
5.4.1 Young Platform reserves the right to make unilateral changes to the conditions of Quests, associated benefits, and the rules for converting Gems, without the obligation of prior notice to Users.
5.4.2 Any substantial changes will be communicated to Users through appropriate means of communication, ensuring maximum transparency in the dynamics of Quests.
5.5 Cancellation or Modification of Quests:
5.5.1 Young Platform may, at any time, cancel or modify any Quest, guided by technical needs or motivated business decisions.
5.5.2 Any changes will be notified to Users in a timely manner through established communication channels, ensuring that Users are promptly and clearly informed.
5.6 Limitations and Liability in case of Violations:
5.6.1 Users acknowledge and accept that the promotions obtained may be subject to limitations and restrictions, explicitly detailed in the conditions of each Quest.
5.6.2 In case of violation of the Terms and Conditions, the User may suffer the loss of accumulated Gems and the suspension of access to promotions, in accordance with the provisions of Young Platform.
Limitation of Liability
6.1 Exclusion of Liability for Losses or Damage:
6.1.1 Young Platform disclaims all liability for any losses, damages, or the like that may arise directly or indirectly from participation in Quests or the use of Gems and promotions.
6.1.2 Users understand and accept that participation in Quests is at their own risk and Young Platform will not be held responsible for any consequences or damage resulting from such participation.
6.2 No Liability for Interruptions and Technical Errors:
6.2.1 Young Platform is absolved of all liability in case of Feature interruptions, technical errors, delays, or any other unavailability that may affect participation in Quests or the conversion of Gems.
6.2.2 Users acknowledge that the use of the Quests Feature involves an awareness of associated technical risks and Young Platform will not be considered liable for any inconvenience arising from such circumstances.
6.3 No Guarantee of Continuity, Modifications, and Changes to Terms and Conditions:
6.3.1 Young Platform provides no guarantee regarding the continuity, completeness, or accuracy of Quests, reserving the right to modify, suspend, or terminate them without notice.
6.3.2 Young Platform may make unilateral changes to these Terms and Conditions at any time. Users will be informed of such changes through appropriate means of communication. Continued use of the Quests Feature after notification will constitute acceptance of the changes.
6.4 Force Majeure and Other Causes Beyond Young Platform’s Control:
6.4.1 Limitation of Liability for Independent Events: Young Platform will not be considered responsible for any delays or failures in fulfilling its obligations due to causes beyond its reasonable control.
6.4.2 Force Majeure Events: these causes include, but are not limited to, force majeure events, technical failures, acts of government authorities, or natural events that make it impossible or excessively burdensome to perform the expected activities.
Exclusion of Warranties
7.1 The User explicitly acknowledges and agrees that Young Platform provides no warranties, whether express or implied, in relation to Quests, Gems, or converted promotions. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and reliability.
7.2 Young Platform expressly excludes any express and implied warranties arising from law, custom, trade practice, or other sources, thereby ensuring a clear detachment from any implied commitment.
7.3 Young Platform provides no guarantee regarding the continuity, accuracy, or efficiency of the Quests Feature, exempting itself from any liability for technical malfunctions, Feature interruptions, or other technical problems that may affect participation in Quests or the conversion of Gems.
7.4 This exclusion of warranties applies broadly and limits any potential liability of Young Platform for any losses, damages, or inconveniences arising from participation in Quests or the use of Gems and converted promotions.
7.5 The User agrees that any liability of Young Platform, should it ever arise, will be limited to the maximum extent permissible by law, including a limitation of liability clause in compliance with applicable regulations.
7.6 Any contrary provision contained in these exclusion of warranty clauses is deemed null and void. To the extent that applicable laws do not allow a total exclusion of warranties or limitations of liability, the clauses will be interpreted to the maximum extent permitted by law.
7.7 Users acknowledge that these exclusion of warranty clauses are an integral part of the Terms and Conditions of the Quests Feature, and participation in Quests implies full acceptance of such provisions.
Privacy and Data Processing
8.1 The User acknowledges and consents that Young Platform will process the personal data provided during participation in Quests and the use of the Feature, in compliance with current privacy regulations.
8.2 The User’s personal data will be processed for the purpose of managing Quests, assigning Gems, enabling conversion into promotions, and providing a better User experience. Young Platform commits to using the data only for the specified and agreed purposes.
8.3 Young Platform adopts adequate technical and organizational measures to ensure the security and confidentiality of the User’s data. This includes protection against unauthorized access, disclosure, alteration, or destruction of personal data.
8.4 Personal data will be stored for the strictly necessary period to achieve the indicated purposes or as required by law. The User may request the deletion of their data in accordance with privacy provisions.
8.5 Young Platform may use personal data to communicate with the User regarding Quests, Gems, promotions, and other aspects related to the Feature. Users may choose to receive or not receive certain communications.
8.6 Young Platform will not share the User’s personal data with third parties without explicit consent, except when required to comply with laws, regulations, or provisions of competent authorities or as disclosed in the following link.
8.7 The User has the right to access their personal data, correct it, delete it, or request the limitation of processing. Furthermore, the User has the right to object to processing for legitimate reasons.
8.8 Young Platform reserves the right to modify this Privacy Policy to reflect any changes in legislation or business practices. Users will be informed of such changes through appropriate means of communication.
Applicable Law and Jurisdiction
These Terms and Conditions are subject to Italian law. For all disputes between the Parties, the competent court is the court of Turin. However, following consumer protection regulations established by Legislative Decree 6 September 2005, no. 206, the competent court will be determined following the provisions of such legislation, ensuring the protection of consumer rights.
