Introduction

These Terms & Conditions govern the use of the Mission Feature (the “Feature”) offered by Young Platform S.p.A. (“Young Platform” or the “Company”) on the Company’s Exchange platform. By accessing or using the Feature, the User agrees to be bound by these Terms & Conditions – Quests provided that they have already accepted the General Terms and Conditions – Young Platform Currency Exchange.

Definitions

Quests: Quests are interactive activities available on the Platform that Users can complete to earn Gems. Quests may include:

• Challenges, such as reaching a specific trading volume, inviting friends to the Platform, or completing quizzes and tutorials.
• Events, including participation in competitions or special events organised by Young Platform.
• Promotions involve performing specific actions to earn Gems, such as making a deposit or activating a new service.

Quests are designed to engage Users and promote Young Platform’s products and services.

Gems: Gems are a form of recognition awarded to Users upon the successful completion of specific Quests.

Nature of the Quests Feature – Promotions

The Quest Feature is designed to promote Young Platform’s products and services through a gamified experience. The process operates as follows:

• Users can participate in various Quests;
• Successfully completing a Quest results in the award of Gems;
• Gems serve as a reward system that allows Users to access incentives and promotions on Young Platform’s services;
• Promotions available through Gems may include, but are not limited to, trading fee discounts, deposit bonuses, or free access to premium services;
• Young Platform defines the specific conditions for earning and using Gems and the types of promotions available, which may be subject to change.

Participation in Quests

4.1 Voluntary Participation
Participation in Quests is free and voluntary. Users are not required to participate in Quests or make any purchases or payments to do so.

4.2 Informed Participation
Before participating in a Quest, Users are encouraged to carefully review its specific conditions to ensure informed and aware participation.

4.3 Purpose of Quests
Quests are intended to enhance User engagement and promote Young Platform’s products and services. Completing a Quest may entitle Users to receive Gems, which can be used to access promotions and benefits within the Platform.

4.4 Non-Monetary Nature of Gems
Gems are a virtual reward system with no intrinsic monetary value and cannot be converted into cash. Gems can be used to access promotions and benefits on Young Platform’s services in accordance with the terms and conditions defined by Young Platform.

4.5 Conversion of Gems
Gems can be converted into promotions and benefits according to the rules established by Young Platform. These rules may be subject to change, and Users are encouraged to regularly check the information relating to Quests and available promotions.

4.6 Expenditure of Gems
Once Gems are used to obtain a promotion or benefit, they are deemed “spent” and cannot be reused.

Eligibility Conditions and Quest Modification

5.1 Eligibility
Participation in Quests is open to all Users of Young Platform who meet the specific eligibility requirements for each Quest. Young Platform reserves the right to amend eligibility requirements at any time. Participation in Quests is guaranteed to all eligible Users without discrimination based on age, gender, nationality, sexual orientation, religion, or other personal factors.

5.2 Conditions for Earning Gems
Users must comply with the specific conditions of each Quest to earn gems and benefit from promotions. Young Platform reserves the right to verify compliance with these conditions and take necessary measures in the event of violations, including revocation of Gems or exclusion from Quests.

5.3 Amendments to the Feature
Young Platform reserves the right to modify, suspend, or terminate Quests, Gems, promotions, and these Terms & Conditions at any time, with or without prior notice. The Company will make reasonable efforts to communicate significant changes to Users via the Platform’s communication channels.

5.4 Restrictions
Gems, promotions, and benefits obtained through the Quest Feature may be subject to limitations and restrictions as specified in the conditions of each Quest or these Terms & Conditions.

5.5 Sanctions for Violations
In case of violations of these Terms & Conditions or any other Young Platform policy, the Company reserves the right to take appropriate measures, including but not limited to:

• Revocation of Gems;
• Suspension or closure of the User’s account;
• Exclusion from Quests;
• Legal action.

Limitation of Liability

6.1 General Exclusions
Young Platform shall not be held liable for any losses, damages, costs, expenses, or harm of any nature, whether direct or indirect, suffered by Users in connection with the Quest Feature, including but not limited to:

• Economic losses, loss of profits, or loss of business opportunities;
• Damage to electronic devices or software;
• Errors, omissions, interruptions, defects, delays, or malfunctions of the Quest Feature;
• Unauthorised or fraudulent use of Gems or promotions;
• Expiry of Gems provided that Young Platform has acted in compliance with these Terms & Conditions.

6.2 Disclaimer of Warranties
Young Platform provides no warranties, express or implied, in relation to the Quest Feature, Gems, or promotions, including but not limited to warranties of:

• Merchantability or fitness for a particular purpose;
• Non-infringement of third-party rights;
• Accuracy, completeness, reliability, availability, continuity, or timeliness of the Quest Feature;
• Absence of errors, viruses, or other harmful components.

6.3 Force Majeure
Young Platform shall not be liable for any delay or failure in performing its obligations due to causes beyond its reasonable control, including but not limited to:

• Acts of God (earthquakes, floods, fires, etc.);
• Acts of public authorities (laws, regulations, orders, etc.);
• Failures or malfunctions of communication networks or IT systems;
• Strikes, lockouts, or other labour disputes.

6.4 Indemnity
Users agree to indemnify and hold harmless Young Platform from any liability for losses, damages, costs, or expenses arising from:

• Breach of these Terms & Conditions by the User;
• Fraudulent or unlawful use of the Quest Feature by the User;
• Negligence or wilful misconduct by the User.

6.5 Limitation of Compensation
Under no circumstances shall Young Platform be liable for indirect, incidental, consequential, special, or punitive damages, even if Young Platform has been advised of the possibility of such damages. The total liability of Young Platform to the User for any damages arising from or in connection with these Terms & Conditions shall be limited to the total amount of Gems accumulated by the User.

Privacy and Data Processing

7.1 Consent
Users acknowledge and consent that Young Platform will process personal data provided during Quest participation and use of the Feature in compliance with applicable privacy laws.

7.2 Purpose of Data Processing
Personal data will be processed to manage Quests, allocate Gems, enable conversion into promotions, and improve the User experience.

7.3 Data Security
Young Platform implements appropriate technical and organisational measures to ensure the security and confidentiality of User data.

7.4 Retention
Personal data will be retained for the period strictly necessary to fulfil the purposes outlined or as required by law.

7.5 Communication
Young Platform may use personal data to communicate with Users about Quests, Gems, promotions, and related aspects.

7.6 Third-Party Sharing
Young Platform will not share User data with third parties without explicit consent, except as required by law or the Company’s Privacy Policy.

7.7 User Rights
Users have the right to access, correct, delete, or request the restriction of their personal data processing, and to object to processing on legitimate grounds.

7.8 Privacy Policy Changes
Young Platform reserves the right to amend its Privacy Policy to reflect legislative or business changes. Users will be notified of such changes through appropriate communication channels.

Applicable Law and Jurisdiction

These Terms & Conditions are governed by Italian law. Any disputes shall be subject to the jurisdiction of the Court of Turin. However, pursuant to consumer protection laws (Legislative Decree 6 September 2005, No. 206), the competent court will be determined in accordance with such provisions, ensuring consumer rights are upheld.
