Custody
Custody, in the context of crypto-assets, refers to the safekeeping and management of the private keys that allow them to be controlled. Unlike traditional assets, “holding” a crypto-asset effectively means controlling the associated keys.
A distinction is drawn between self-custody, in which the user keeps their own keys, and third-party custody, in which an operator keeps the keys on the client’s behalf. The custody of crypto-assets on behalf of third parties is a service subject to the applicable regulation, including the MiCAR Regulation.
