Financial Instrument

A financial instrument is a contract that grants its holder financial rights. This category includes, for example, shares, bonds, fund units and derivative products such as futures and options.

Financial instruments are governed by specific regulations, and their offer, trading and management are reserved for authorised entities. The category is distinct from that of crypto-assets, which are instead governed by Regulation (EU) 2023/1114 (MiCAR).

Some instruments, such as tokens that incorporate rights typical of financial instruments, may fall under the rules on financial instruments rather than those on crypto-assets: the classification depends on the instrument’s concrete characteristics.
