Opt-in to the Administered Regime pursuant to Article 16-bis of the General Terms & Conditions
This form is reserved for Users who are natural persons, non-commercial entities or simple partnerships (società semplici) resident in Italy for tax purposes and who wish to join the Administered Regime. The form is offered to new Users at the end of the customer due diligence procedure that follows registration, and is available at any time in the tax section of the App, including to Users who already hold an account and to those who have previously revoked the Election.
Acceptance of the General Terms & Conditions, including any updated version, does not in itself constitute exercise of the Election: to join the Administered Regime, this form must be accepted. Otherwise, the Self-Assessment Regime applies.
Users whose registered residence, as shown by the customer due diligence, is outside Italy are not required to complete this form: in that case, the Administered Regime applies without the need for an Election, as provided for in Article 15 of the Administered Savings T&Cs. Such Users complete this form only if, having validly waived the Administered Regime under Articles 15.2 and 15.3 of the Administered Savings T&Cs, they wish to request that it apply again under Article 15.4 of the Administered Savings T&Cs.
Capitalised terms have the meaning given to them in the General Terms & Conditions of Young Platform S.p.A. (the “Terms & Conditions“) and in the Administered Savings Terms & Conditions (the “Administered Savings T&Cs“).
User declarations
The User, under their own responsibility, declares:
- that they are a natural person, a non-commercial entity or a simple partnership resident in Italy for tax purposes under Article 2 or Article 73 of the Italian Consolidated Income Tax Act (TUIR), and that they are not considered resident for tax purposes in another State under the applicable double taxation convention or, in the case referred to in Article 15.4 of the Administered Savings T&Cs, that their registered residence is outside Italy and that they have previously waived the Administered Regime;
- that they hold the Crypto-assets on the Platform other than in the course of a business or commercial activity;
- that, before signing this form, they have received and read Article 16-bis of the General Terms & Conditions and the Administered Savings T&Cs;
- that the information provided to Young Platform is true, accurate and complete, and that they undertake to notify the Company of any change in their Tax Residence or registered residence within 30 (thirty) days and to provide supporting documentation on request, acknowledging that, failing this, the Company will treat the most recently provided information as valid.
Exercise of the Election
By signing this form, the User elects for the administered savings regime (regime del risparmio amministrato) under Article 6 of Legislative Decree No. 461 of 21 November 1997 and the corresponding provisions of the consolidated acts replacing it (the “Administered Regime“), in respect of the Crypto-asset custody and administration relationship held with Young Platform S.p.A. and linked to their Wallet.
Start date and duration
- If this form is signed by a new User at the end of the customer due diligence procedure, at the same time as the relationship is opened, the Administered Regime applies from 1 January 2027 or, if later, from the date on which the relationship is opened.
- If this form is signed at a later stage, including by a User who is already registered, the Administered Regime applies from 1 January of the year following the year of signature and, therefore, from 1 January 2027 if signed by 31 December 2026. Until that date, the Self-Assessment Regime continues to apply.
- The Election applies for the entire tax year and is tacitly renewed from year to year.
- The User may revoke the Election at any time using the Revocation Form (the “Opt-out“) available in the tax section of the App. Revocation takes effect from the tax year following the one in which it is notified. For each tax year, the applicable regime is determined by the last choice made by the User by 31 December of the preceding tax year.
Main effects of the Administered Regime
In summary, and referring to the Administered Savings T&Cs for full details:
- Young Platform, acting as withholding agent, calculates the substitute tax due on miscellaneous income realised within the relationship, withholds it from the consideration for the transaction or charges it to the User, and pays it to the Italian Treasury;
- capital losses realised within the relationship are offset against subsequent capital gains, within the limits and in the manner laid down by applicable law;
- the tax base cost of the Crypto-assets is determined in accordance with the Administered Savings T&Cs. For Crypto-assets transferred to the Platform from external addresses, the cost is recognised only if documented through the procedure set out in the Administered Savings T&Cs; otherwise, it is deemed to be zero. For Crypto-assets deposited before the date from which the Administered Regime applies, documentation may be provided up until the first transaction carried out by the User from that date, as provided for in Article 6-bis of the Administered Savings T&Cs;
- the activities listed in the Administered Savings T&Cs remain excluded from the Administered Regime;
- Young Platform provides the User each year with a statement of the taxes applied and paid.
Important notices
The User acknowledges that: (i) if any information or notification is inaccurate or incomplete, any tax not applied or applied at too low a rate, together with the related penalties and interest, will be recovered solely from the User; (ii) the tax information provided by Young Platform does not constitute tax advice, and the User is encouraged to consult a professional to assess which regime best suits their circumstances.
Signature
By selecting the “Sign” button, the User signs this form electronically, after authenticating in the App. A copy of the signed form is made available to the User on a durable medium in the User Area, in the tax section. For non-commercial entities and simple partnerships, this form is signed by the legal representative.
