Opt-out for switching to the Self-Assessment Regime pursuant to Article 16-bis of the General Terms & Conditions
This form is reserved for Users to whom the Administered Regime applies and who wish to switch to the Self-Assessment Regime, and in particular:
(i) Users whose registered residence is in Italy and who signed the Election Form at the end of the customer due diligence procedure or at a later stage;
(ii) Users whose registered residence, as shown by the customer due diligence, is outside Italy, to whom the Administered Regime applies without the need for an Election, under the conditions set out in the “Start date” section.
Users who have not signed the Election Form are not required to complete this form: the Self-Assessment Regime continues to apply to them.
Capitalised terms have the meaning given to them in the General Terms & Conditions of Young Platform S.p.A. (the “Terms & Conditions“) and in the Administered Savings Terms & Conditions (the “Administered Savings T&Cs“).
Purpose of the request
Depending on the registered residence shown by the customer due diligence, by signing this form the User:
- if their registered residence is in Italy, revokes the election for the administered savings regime (regime del risparmio amministrato) under Article 6 of Legislative Decree No. 461 of 21 November 1997 and the corresponding provisions of the consolidated acts replacing it, made through the Election Form;
- if their registered residence is outside Italy, waives the Administered Regime, applicable under Article 15 of the Administered Savings T&Cs, and opts for the Self-Assessment Regime, under the conditions set out in the “Start date” section.
Start date
For Users whose registered residence is in Italy, the revocation takes effect from the tax year following the one in which it is notified to Young Platform; for each tax year, the applicable regime is determined by the last choice made by the User by 31 December of the preceding tax year. Therefore:
- if the revocation is signed by 31 December 2026, the Administered Regime does not apply and the Self-Assessment Regime continues to apply;
- if the revocation is signed on or after 1 January 2027, the Administered Regime continues to apply until 31 December of the current year and the Self-Assessment Regime applies from 1 January of the following year.
If the Administered Regime already applies in the current year and the User revokes the Election, Young Platform will continue to apply and pay the taxes on the User’s transactions for the current year; the switch to the Self-Assessment Regime will take place from the following 1 January.
For Users whose registered residence is outside Italy, signing this form is not in itself sufficient: the waiver is valid and effective only if, after signing, the User sends Young Platform, at [email protected], a certificate of tax residence issued by the authority of the foreign State or other documentation capable of proving their tax residence outside Italy, and Young Platform verifies that it is adequate. The waiver takes effect from the first transaction after the verification has been completed and the User has been notified; until then, the Administered Regime continues to apply. If the documentation is not provided or the verification has a negative outcome, this form has no effect, as provided for in Articles 15.2 and 15.3 of the Administered Savings T&Cs.
Effects of switching to the Self-Assessment Regime
From the date on which the revocation or waiver takes effect:
- the User independently calculates, declares in their tax return and pays the taxes due on income from Crypto-assets, and must comply with the tax monitoring obligations laid down by applicable law;
- Young Platform no longer applies the substitute tax to the User’s transactions and makes the notifications required by law;
- Young Platform provides the User with the tax values of the Crypto-assets held and any capital losses not yet offset, which may be used in accordance with applicable law;
- Stamp Duty under Article 16 of the Terms & Conditions continues to apply unchanged.
The revocation or waiver does not amount to withdrawal from the Terms & Conditions and does not affect the other services provided by Young Platform.
Rejoining
Users resident in Italy for tax purposes who have revoked the Election may rejoin the Administered Regime by signing the Election Form available in the tax section of the App, with effect from 1 January of the year following the year of signature. In the same way and with the same effect, Users whose registered residence is outside Italy and who have waived the Administered Regime may request that it apply again, as provided for in Article 15.4 of the Administered Savings T&Cs.
